MacDonough, a nonpartisan adviser on parliamentary rules and procedure, ruled Thursday morning that a number of provisions related to Medicaid cuts violated the so-called Byrd Rule, named for the late Sen. Robert Byrd (D., W.Va.). The rule mandates that the reconciliation process—which allows the Senate to pass legislation with a simple majority rather than the 60 votes typically required—can only be used to advance provisions with a fiscal impact that isn’t merely incidental.
