Mistakenly deported Salvadoran native Kilmar Abrego Garcia is on his way back to the United States where he will face criminal charges for allegedly transporting undocumented migrants within the U.S., according to sources familiar with the matter.
More than two months after the Trump administration admitted it mistakenly deported Abrego Garcia from Maryland to his native El Salvador, a federal grand jury has indicted him for allegedly transporting undocumented migrants within the United States, ABC News has learned.
A two-count indictment, which was filed under seal in federal court in Tennessee last month, alleges Abrego Garcia, 29, participated in a years-long conspiracy to haul undocumented migrants from Texas to the interior of the country, according to sources briefed on the indictment.
The alleged conspiracy spanned nearly a decade and involved the domestic transport of thousands of non-citizens, including some children, from Mexico and Central America.

(29,571 posts)The big ding on his history was that he was driving a car with, I can't remember exactly, maybe 5-10 people. They were driving to a work site many miles away, and his license had expired. He was let off with a warning. This indictment came about just last week in a secret closed jury, as the regime is trying to cover their asses. They're still claiming he has ties to M-13, though the indictment doesn't provide any proof.

(1,155 posts)...it accuses some people of getting money through wire transfers, but none of the those persons are Abrego-Garcia. The only thing they have that's solid is the Tennessee traffic stop, where none of the persons in the car other than Abrego-Garcia were identified.
This might not get laughed out of court, but if Abrego-Garcia has any kind of competent legal representation this case is going nowhere.

(10,642 posts)They are trying to make the 2002 traffic stop with all the workers in his truck the basis for this.
He was driving a bunch of workers and the Tennessee troopers thought it looked like trafficking but they let him go per the FBI's direction.
My guess is that they have pressured some of these other workers or other people to testify by threatening them with prison in another country using Kilmar's treatment as an example. So now they have their case.

Andry is a 32-year-old Venezuelan man imprisoned - at the U.S. governments direction and expense - at El Salvadors notorious CECOT mega-prison. Andry is a gifted makeup artist and actor who came to the United States in 2024 seeking asylum from persecution in Venezuela related to his sexual orientation and political beliefs. DHS claimed Andrys tattoos connect him to the Tren de Aragua gang but never afforded Andry or his legal team the opportunity to rebut the baseless allegations in court. Andry has no criminal history in his home country or the United States.

DHS is doing everything it can to erase the fact that Andry came to the United States seeking asylum and he was denied due process as required by our Constitution. We should all be incredibly alarmed at what has happened in Andrys case. The idea that the government can disappear you because of your tattoos, and never even give you a day in court, should send a chill down the spine of every American. If this can happen to Andry, it can happen to any one of us.
The dismissal of his asylum claim is not the end of Andrys story. Andrys life depends on us holding the Trump administration accountable for what they have done to him. The fight for justice for Andry, our seven other ImmDef clients imprisoned at CECOT, and all the men unjustly disappeared continues with renewed determination today. Im making no judgement on garcias guilt or innocence. Maybe hes not a great person. It really doesnt matter. At least now Garcia wont be rotting away in that prison in El Salvador and will have his day in court. Im glad the courts havent completely given in (yet).

I have a feeling his life is going to take a substantial turn for the worse now. I never really understood why he was incarcerated down there in the first place. Does anyone here know why?

Schrader's resignation was prompted by concerns that the case was being pursued for political reasons, the sources said.
Schrader, who spent 15 years in the U.S. Attorney's Office in Nashville and was most recently the chief of the criminal division, declined to comment when contacted by ABC News.

(10,642 posts)Someone like a boss or a colleague could have asked him to drive them to the next job site. They didn't have any luggage which is why the trooper suspected trafficking but that still doesn't mean that Kilmar was aware. He was just driving them to a drop off point it seems. Supposedly the FBI told the TN troopers to let him go but that's all getting really sketchy. They say to talk to TN and TN supposedly hasn't released all of the video where they are talking to Federal agents.

We got spoiled by the Burger court. We had, for a brief moment in time, a Supreme Court that was actually interested in advancing justice and expanding Constitutional protections to what were actually intended (but not for slavesthat had to wait until after the Civil War). That time, unfortunately, didnt last.
The SC is now issuing rulings without regard to the Constitution, the law, or any sort of logic.
