(45,490 posts)She isn't seeing a new trial. She is seeking the complete dismissal of her prosecution based on the argument that there was a plea deal in place that prevented her from being prosecuted.
That being said, I think the Court will deny her petition for cert because it's a pretty tenuous argument, based on a 2007 plea agreement between federal prosecutors in Florida and Epstein that purports to give immunity to unnamed co-conspirators. The government's position has been that the plea agreement did not prevent federal prosecutors in New York from pursuing charges against Maxwell.

(10,053 posts)Looks like about 150 women got close to a million each from the Epsteins Victim Compensation Program. The fund paid out around $125 million - The fund received 225 applications for compensation according to Groc.

Dancing Hare (formerly Lady Ghislaine and Lady Mona K) is a superyacht built by Amels in 1986.
Built for Emad Khashoggi, it was then purchased, also in 1986, by Robert Maxwell, who died by drowning whilst cruising on the yacht off the Canary Islands. It was then owned by an Arabian businessman who sold it in 2017. The new owner, Anna Murdoch, had it refitted and renamed Dancing Hare.
Khashoggi, also developer of the Château Louis XIV and the Palais Rose, abandoned the project for the yacht and in 1986 sold the vessel to Robert Maxwell who named it Lady Ghislaine after his daughter Ghislaine. In 1991, it was the base for Maxwell in New York City, moored on the East River as he negotiated with the unions over his purchase of the New York Daily News.[3][4][5]
Maxwell's death
On 5 November 1991, at the age of 68, Maxwell was on board Lady Ghislaine, which was cruising off the Canary Islands. Maxwell's body was subsequently found floating in the Atlantic Ocean. He was later buried in Jerusalem. The official verdict was accidental drowning,[6] though some commentators have surmised that he may have committed suicide[3] or been murdered.[7]

(651 posts)Ghislaine Maxwell's father, Robert Maxwell, did not "slip and drown" in the typical accidental sense. He died under mysterious circumstances on November 5, 1991, after disappearing from his yacht, the Lady Ghislaine, which was anchored near the Canary Islands.
His body was later found floating in the Atlantic Ocean. Although the official cause of death was listed as a heart attack combined with accidental drowning, many have speculated foul play or suicide, especially since it was later revealed he had embezzled hundreds of millions of pounds from his companies' pension funds.

(45,490 posts)Maxwell's petition for certiorari originally was due in January. At her request, Justice Sotomayor extended that deadline until April 10. The government's response was due May 14. It was extended until June 13 and then, without objection from Maxwell, extended again until July 14.
The headline on the original story was accurate. The person who tweeted about it got it wrong.
Also, she isn't seeking a new trial. She is arguing that she shouldn't have been prosecuted in the first place because of a plea deal. Specifically, the question she is raising for the Court consider is the following: "Under Santobello and common principles of contract interpretation, does a promise on behalf of the United States or the Government that is made by a United States Attorney in one district bind federal prosecutors in other districts?"

(45,490 posts)There is nothing in her petition for certiorari suggesting she is seeking a new trial. She is asking that her conviction be reversed because of a prior plea deal which she argues barred the prosecution.

(45,490 posts)As pointed out multiple times above, she isn't filing anything tomorrow. She filed a petition for certiorari in April. The government's response is due tomorrow. The issue -- the ONLY issue -- being raised is whether she shouldn't have been prosecuted because of a 2007 plea deal that she claims gave immunity not only to Epstein but to unnamed co-conspirators.
If cert is granted, the court will decide whether she should have been prosecuted or not. If so, she loses and her conviction stands. If not, the conviction is vacated and that's the end of it because she can't be prosecuted.
Discovery has absolutely nothing to do with this case at this point.
