Trump has issued several executive orders sanctioning law firms with penalties that include losing government contracts and security clearances. Four of those firms sued to fight his actions and they have racked up an undefeated record in court, with judges issuing rulings in each case blocking and excoriating Trumps orders.
U.S. District Judge Loren L. AliKhan ruled that Trumps order punishing the firm was unconstitutional and protected by the free speech clause of the First Amendment, as well as the due process clause of the Fifth Amendment.
[E]very court to have considered a challenge to one of these orders has found grave constitutional violations and permanently enjoined enforcement of the order in full, AliKhan wrote in a 53-page opinion accompanying her ruling. Today, this court follows suit, concluding that the order targeting Susman violates the U.S. Constitution.
Her ruling follows similar decisions from judges who struck down Trumps punishments for the law firms WilmerHale, Jenner & Block and Perkins Coie. Judges in those cases found that Trump retaliated against the firms for activity protected by First Amendment activity and sought to use his offices power to cajole them into falling in line.
I have a former debate squad member and some friends at this firm. Steve Susman was an amazing man and it was his condo, I got to meet and discuss stuttering with Joe Biden.
Susman is also representing the ABA in the ABA's lawsuit against these stupid attempts to intimidate law firms.
