All they have to do is pick one of the many cases the supreme court will hear regarding some illegal action and, regardless of their decision, that will let them assume dictatorial power.

1. Court rules in their favor: This will give them carte blanche to ignore any law.
2. Court rules against them: They will simply ignore the ruling and continue to ignore any law.

This is the giant loophole: The court has "no influence over the sword or the purse." In fact, Trump made a statement referencing this during his first term where he observed that the supreme court "has no army" to enforce its rulings.
