And they're flailing around trying to figure out how to explain that the people they send to El Salvador are treated like literal garbage and no records are kept - something ICE probably knew all along.

This Courts order to facilitate Abrego Garcias return was issued one week ago. It was
not stayed until Monday afternoon. Accordingly, the Government should have been taking actions
Friday, Saturday, Sunday, and Monday morning, and the Government can report on those. The

Supreme Court lifted the stay yesterday evening. Accordingly, the Government should have been
taking actions last night and this morning, and it can report on those. The Government should
likewise be in a position to tell the Court in general terms what its further plan is to facilitate Mr.
Abrego Garcias return, and who in the Government is responsible for implementing that plan.

mans life and safety is at risk. Its request for an extensionfiled this morning in defiance of the
Courts rules requiring consultation with Plaintiffs counselis another stunning display of
arrogance and cruelty. It did not take that time to ponder whether to remove Garciawhich it
effectuated within 72 hours of his unlawful seizureand it does not need that time to comply with
this Courts and the Supreme Courts rulings. We vigorously oppose the Governments motion,

ORDER
The Defendants ask this Court to extend the deadline to respond to its Order at ECF No.
51, arguing that the Defendants require several days to "meaningful[ly] review the Supreme Court's decision," issued last night at 7:00 PM, and that it is "impracticable for Defendants to
comply with the Court's 9:30 AM deadline only a few hours after the Supreme Court issued an order in this case." ECF No. 55. This, Defendants say, supports extension of the filing deadline until April 15, 2025. The Court largely rejects the Defendants' request.
First, the Defendants' act of sending Abrego Garcia to El Salvador was wholly illegal
from the moment it happened, and Defendants have been on notice of the same. Indeed, as the Supreme Court credits, "the United States acknowledges that Abrego Garcia was subject to a withholding order forbidding his removal to El Salvador, and that the removal to El Salvador was therefore illegal." Noem v. Abrego Garcia, 604 U.S.__ (2025), Slip Op. at 1. Second, the Defendants' suggestion that they need time to meaningfully review a four-page Order that
reaffirms this basic principle blinks at reality. Third, the Defendants misconstrue the Supreme
Court's Order stating that the original deadline at ECF No. 21 is "no longer effective," as

somehow suggesting that the Court's amended Order requiring prompt attention to this matter is
"inconsistent" with the Supreme Court's directive. Nothing could be further from the truth. As
the Supreme Court plainly stated, "the Government should be prepared to share what it can concerning the steps it has taken and the prospect of further steps," Slip Op. at 2 - all against the backdrop of this Court's needing to "ensure that the Government lives up to its obligations to
follow the law." Id. at 4 (Sotomayor, J., concurring).
Accordingly, the Court GRANTS in part the request and will extend the filing deadline
until 11:30 AM today. The hearing date and time will remain unchanged.

Following the Supreme Courts ruling Thursday evening that upheld the thrust of U.S. District Judge Paula Xiniss order, she scheduled a Friday hearing in her Greenbelt, Md., courtroom at 1 p.m. EDT.
The Justice Department asked Xinis to postpone the hearing until next Wednesday and delay a Friday morning deadline to provide a written update, saying the timeline was impracticable.
The judge agreed to give the government two additional hours to provide the written update but declined to move the hearing, chastising the Justice Department for its demand.
First, the Defendants act of sending Abrego Garcia to El Salvador was wholly illegal from the moment it happened, and Defendants have been on notice of the same, Xinis wrote.

Non-update: We are now past noon with no responsive filing from DOJ.
The *only* possibility here that I can think of beyond outright ignoring the deadline is that DOJ submitted something to chambers directly. There would still be issues and questions there, but, that's all I can think of.

U.S. District Judge Paula Xinis began a hearing Friday on Abrego Garcia's deportation by asking the government to answer where Kilmer Armando Abrego Garcia is.
"Where is he and under whose authority?" she repeatedly asked.
"I do not have that knowledge, and therefore I cannot relate that knowledge," DOJ attorney Drew Ensign said.
"I'm not asking for state secrets, I'm asking where one man who is wrongly and illegally deported, removed from this country [is]," Xinis said.
"Your Honor, I do not have the information provided to me that I can provide to you," Ensign said again.
The judge decided to go ahead with Friday's hearing after the Trump administration sought to delay the hearing until next week. The Justice Department on Friday morning asked her to reschedule the hearing for Wednesday, April 16, two days after El Salvador President Nayib Bukele is scheduled to meet with the White House -- but the judge, in a filing, kept the hearing date as scheduled.
Xinis, at the start of the hearing, said has three questions for DOJ: The current physical location and custodial status of Abrego Garcia, what steps the Trump administration has taken to facilitate his return, and what additional steps the government will take and when to facilitate Abrego Garcia's return.

U.S. District Judge Paula Xinis scolded the administration for refusing to provide even basic details about Kilmar Abrego Garcias location, despite her demand for an update by Friday morning.....
The administrations stonewalling, which Xinis described as extremely troubling, raised the specter that it is defying the order that the judge issued last week and that the Supreme Court largely upheld Thursday.
Xinis, an Obama appointee, said that without any information or even an acknowledgment that the administration had done anything at all she could only conclude that the administration had done nothing to facilitate the return of Mr. Abrego Garcia.
Theres an easy way to combat that, she said, and thats just to tell me whether youve done anything and if so, what.
Xinis new directive requires the daily updates to come from an administration official with personal knowledge of efforts to return Abrego Garcia to the United States. But Justice Department officials said they may not be prepared to comply with her demands until at least Monday......
Xinis told Ensign that if Trump administration officials were depriving him of information she demanded, then you dont have full and effective contact with your clients.
