Most of TFG's briefs opposing the release of the Special Counsel filing were claims that this was a partisan exercise and the facts in the filing should not be released so close to the election. In her opinion releasing the Special Counsel brief, Judge Chutkan called out TFG's counsel for advancing political rhetoric that has no basis in law. The best is when Judge Chutkan noted that TFG's claims are unbefitting of experienced defense counsel

(15 posts)Her postponing this would be equal to a judge postponing the release of information regarding a person charged with the murder of their spouse because they were planning on getting married again and the evidence might prejudice the next potential spouse. The purpose of the legal system should be to protect others from being victimized, just as much as punishment for the guilty.

(2,301 posts)That the bulk of these filings and motions are little more than press releases to Trump's fan club and for right wing media sound bites rather than being actual legal arguments meant to persuade the judge of their client's position.
It's old, and everyone including the Judge is tired of it.

Once again, screwed by incompetent legal counsel. You get what you pay for.

(152,718 posts)I am shocked that TFG's made the 60 day and other election interference claims in filings. These claims are frivolous and should be sanctioned. I love how Judge Chutkan asked "how this court is bound by or has jurisdiction to enforce Department of Justice policy."

In reality, a federal judge, not Smith, made the decision to release that filing to the public.....
Chutkan has repeatedly made clear in court hearings that Trumps presidential run and campaign schedule despite the protestations of Trumps team will have no impact on the criminal case before her. The judge made that point explicitly in an order last month, writing that Trumps concern with the political consequences of these proceedings does not bear on the pretrial schedule......
Smith's team suggested, Chutkan reviewed the brief and ultimately decided that the redactions were appropriate. Chutkan also responded to Trump's earlier complaints about potentially violating the 60-day rule, writing on Sept. 24 that his team could now explain "how this court is bound by or has jurisdiction to enforce Department of Justice policy.".....
The 60-day period does not apply to judges, nor does it generally apply to pending cases, although that's always subject to discretion if prosecutors want to avoid taking certain actions even in pending cases. Chuck Rosenberg, a Justice Department veteran and NBC News legal analyst, said Smith's team was doing things by the book.
